CANON O SUS CONCESIONARIOS

IMPORTANTE

El presente documento es un contrato legal (el "Acuerdo") entre usted y Canon Inc. ("Canon") que 
rige el uso de los programas de software de Canon y de sus concesionarios incluidos en este 
controlador de impresora de Canon para Linux suministrado junto con este Acuerdo ("Producto") y 
cuyos programas de software se enumeran en la Lista 1 del archivo Readme. Dichos programas de 
software de Canon o de sus concesionarios serán definidos de ahora en adelante como "Software".

LEA DETENIDAMENTE ESTE DOCUMENTO Y ACEPTE TODOS LOS DERECHOS Y 
RESTRICCIONES DESCRITOS EN EL PRESENTE ACUERDO ANTES DE USAR EL 
SOFTWARE.

AL USAR EL SOFTWARE TAL Y COMO SE DESCRIBE EN LA SECCIÓN 1 A 
CONTINUACIÓN, USTED ESTÁ ACEPTANDO SU VINCULACIÓN CON LOS TÉRMINOS Y 
LAS CONDICIONES DEL PRESENTE CONTRATO. SI NO ESTÁ DE ACUERDO CON LOS 
TÉRMINOS Y CONDICIONES DE ESTE CONTRATO, NO UTILICE EL SOFTWARE Y 
DEVUÉLVALO INMEDIATAMENTE AL LUGAR DONDE FUE ADQUIRIDO.

1. CONCESIÓN DE LA LICENCIA

Canon le concede una licencia personal, limitada y no exclusiva para el uso (el término "uso" en el 
presente contrato incluye las acciones de almacenamiento, carga, instalación, acceso, ejecución o 
visualización), copia, distribución y permisión a terceras partes para usar y copiar el Software 
exclusivamente en el producto. Podrá modificar el Software para su propio uso, así como emplear 
técnicas de ingeniería inversa para depurar dichas modificaciones. Podrá distribuir el Software a 
terceros bajo los mismos términos y las mismas condiciones que se exponen en el presente 
documento. 

2.RESTRICCIONES

Salvo que se establezca o permita expresamente en el presente contrato, no podrá usar, ceder, 
subcontratar, vender, alquilar, arrendar, prestar, traspasar o transferir el Software a terceras partes.

3. MARCA DE COPYRIGHT

No podrá modificar, quitar o borrar ninguna marca de Copyright de Canon o sus concesionarios que 
aparezca en el Software o en cualquiera de sus copias.

4.PROPIEDAD

Canon y sus concesionarios conservan en su totalidad la titularidad, la propiedad y los derechos sobre 
la propiedad intelectual del Software y su contenido. A excepción de lo establecido expresamente en 
el presente contrato, Canon no le concede ni traspasa ninguna licencia o derecho, expreso o implícito, 
sobre la propiedad intelectual de Canon y sus concesionarios.

5.RESTRICCIONES DE EXPORTACIÓN

Usted acepta cumplir con la legislación sobre exportaciones, así como con las restricciones y 
regulaciones del país implicado, y no exportar o volver a exportar el Software, de manera directa o 
indirecta, si con ello infringe dicha legislación, las restricciones y regulaciones, o si carece de los 
permisos necesarios.

6.GARANTÍA Y DESCARGO DE RESPONSABILIDAD

EL SOFTWARE SE CONCEDE "TAL CUAL", SIN GARANTÍA DE NINGÚN TIPO, YA SEA 
EXPRESA O IMPLÍCITA, INCLUIDAS, AUNQUE NO EXCLUSIVAMENTE, LAS 
GARANTÍAS IMPLÍCITAS DE COMERCIALIZACIÓN E IDONEIDAD PARA UN PROPÓSITO 
DETERMINADO. LA CALIDAD, EL FUNCIONAMIENTO Y EL RENDIMIENTO DEL 
SOFTWARE SE ENCUENTRA BAJO SU PROPIA Y EXCLUSIVA RESPONSABILIDAD. EN 
CASO DE QUE EL SOFTWARE PRESENTE DEFECTOS, DEBERÁ ASUMIR EL COSTE 
ÍNTEGRO DE TODOS LOS SERVICIOS, REPARACIONES O CORRECCIONES 
NECESARIOS.

CANON, SUS SUBSIDIARIAS O AFILIADAS, DISTRIBUIDORES, REPRESENTANTES O 
CONCESIONARIOS NO SE HACEN RESPONSABLES EN NINGÚN CASO DE NINGÚN TIPO 
DE DAÑO (INCLUIDOS PERO NO EXCLUSIVAMENTE, LA PÉRDIDA DE BENEFICIOS 
COMERCIALES, LA PÉRDIDA DE INFORMACIÓN COMERCIAL, LA INTERRUPCIÓN DE 
LA ACTIVIDAD COMERCIAL Y OTROS DAÑOS COMPENSATORIOS, INCIDENTALES O 
DERIVADOS) ORIGINADO POR EL SOFTWARE, SU USO O LA INCAPACIDAD DE USARLO 
INCLUSO SI CANON, SUS SUBSIDIARIAS O AFILIADAS, DISTRIBUIDORES, 
REPRESENTANTES O CONCESIONARIOS CONOCEN LA POSIBILIDAD DE QUE SE 
PRODUZCAN DICHOS DAÑOS.

CON LA ACEPTACIÓN DEL PRESENTE CONTRATO, Y CON TODO EL ALCANCE 
PERMITIDO POR LA LEGISLACIÓN APLICABLE, USTED EXIME A CANON, SUS 
SUBSIDIARIAS Y AFILIADAS, DISTRIBUIDORES, REPRESENTANTES Y 
CONCESIONARIOS DE CUALQUIER Y TODA RESPONSABILIDAD ORIGINADA O 
RELACIONADA CON TODAS LAS RECLAMACIONES CONCERNIENTES AL SOFTWARE O 
A SU USO.

7.VENCIMIENTO DE LA LICENCIA

Este Acuerdo es efectivo desde el momento en que indica su aceptación al utilizar el Software y 
permanece vigente hasta su vencimiento. Puede anular este Acuerdo en cualquier momento 
destruyendo el Software. 

Canon puede anular este Acuerdo en caso de que no cumpla las condiciones estipuladas en el presente 
contrato. Cuando se produzca la expiración del Acuerdo, deberá destruir el Software inmediatamente 
para proteger los derechos legales de Canon, que también ejercerá sus derechos legales respectivos. 

Independientemente de lo establecido en las cláusulas anteriores, las cláusulas 4, y de la 6 a la 10 
permanecerán vigentes tras la expiración de este Acuerdo.

8.U.S. GOVERNMENT RESTRICTED RIGHTS NOTICE

Un "usuario final del gobierno de EE. UU." hace referencia a cualquier agencia o entidad 
perteneciente al gobierno de EE. UU. Si usted es un usuario final del gobierno de EE. UU., se

The SOFTWARE is "commercial items," as that term is defined at 48 C.F.R. 2.101 (October 1995), 
consisting of "commercial computer software" as such terms are used in 48 C.F.R. 12.212 
(September 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 
(June 1995), all U.S. Government End Users shall acquire the SOFTWARE with only those rights set 
forth herein.

Japan.

9.VALIDEZ

Si cualquiera de las disposiciones anteriores se declarase ilegal por cualquier juzgado o tribunal con 
jurisdicción competente, dichas disposiciones se considerarían nulas en la jurisdicción de dicho 
juzgado o tribunal y todas las disposiciones restantes del presente contrato seguirían en vigor.

10.RECONOCIMIENTO

ACEPTA QUE ESTE CONTRATO ES LA DECLARACIÓN DEL ACUERDO COMPLETO Y 
EXCLUSIVO ENTRE USTED Y CANON CONCERNIENTE AL TEMA TRATADO EN EL 
PRESENTE CONTRATO Y QUE, POR LO TANTO, REEMPLAZA TODOS LOS ACUERDOS 
ANTERIORES, VERBALES O ESCRITOS, Y CUALQUIER OTRA FORMA DE 
COMUNICACIÓN ENTRE USTED Y CANON RELACIONADA CON EL TEMA TRATADO.
